Cookies Policy

Effective Date: October 15, 2026

1. Introduction

includX, LLC ("includX," "we," "us," or "our") uses cookies and similar technologies to operate our websites and platform, improve user experience, measure performance, and understand how visitors and users interact with our services.

We also use tracking and attribution technologies to evaluate marketing campaigns, creator referrals, brand partnerships, and other activities associated with our services.

This Cookies Policy explains the technologies we use, the information they may collect, how that information is processed, and your choices regarding optional tracking.

For our initial launch, we provide two cookie consent choices: Accept or Decline. These choices apply to all optional analytics, marketing, and behavioral attribution technologies together.

This policy applies to the includX marketing website at includx.com, the includX platform at app.includx.com, and includX-operated campaign websites and referral links where this policy is made applicable.

For additional information about how we handle personal information, please review our Privacy Policy.

2. What Are Cookies and Similar Technologies?

Cookies are small text files stored on your device when you visit a website. They help websites maintain essential functionality, remember preferences, recognize returning visitors where permitted, and understand website activity.

We may also use related technologies, including:

  • Browser local storage and session storage.
  • Analytics tags and software development kits (SDKs).
  • Tracking pixels and measurement technologies.
  • Campaign parameters and referral identifiers.
  • Server-side event collection and attribution systems.

Not all of these technologies place cookies directly on your device. Some operate through our servers or process information associated with website requests.

Where these technologies involve personal information, their use is subject to our Privacy Policy and applicable privacy requirements.

3. How We Use Cookies and Tracking Technologies

We use cookies and related technologies for the following purposes.

Essential Website and Platform Operations

To provide essential website and application functionality, maintain security, support authentication, process requests, and operate necessary services.

Essential technologies may operate regardless of whether you accept or decline optional tracking, where permitted by applicable law.

Preferences and User Experience

To remember your cookie consent choice and support essential website preferences.

Website Analytics

To understand how visitors discover and interact with the includX marketing website, including page views, traffic sources, navigation patterns, and interactions with website content.

Platform Product Analytics

To understand how users interact with includX platform features, including onboarding, creator profiles, campaign discovery, invitations, collaborations, and other product workflows.

Campaign and Referral Attribution

To understand how marketing campaigns, creator referrals, promotional links, event activations, and partner channels contribute to website visits, inquiries, registrations, and other measurable outcomes.

Marketing Performance

To measure campaign effectiveness, evaluate promotional activities, and improve marketing performance.

Optional analytics, marketing, and behavioral attribution activities are governed by your Accept or Decline selection and applicable privacy requirements.

4. Technologies and Service Providers

Google Analytics 4 (GA4)

We use Google Analytics 4 to measure traffic, visitor engagement, and conversion activity on the includX marketing website and applicable campaign pages.

Google Analytics may process information such as page views, website interactions, browser and device characteristics, approximate location, referral sources, and campaign parameters.

Where enabled, Google Analytics may use cookies or related identifiers to support measurement.

We may also transmit eligible conversion events from our servers to Google Analytics through supported server-side measurement methods.

If you select Decline, we will not activate optional GA4 analytics tracking or send your optional analytics events to GA4.

PostHog

We use PostHog to analyze product usage and engagement within the includX platform.

PostHog helps us evaluate onboarding, platform adoption, creator and brand workflows, feature performance, and user engagement.

Depending on the implementation, PostHog may process interaction events, device or session identifiers, account references, and related technical information.

We may transmit eligible events through client-side or server-side integrations.

If you select Decline, optional PostHog behavioral analytics will remain disabled. Essential platform operations and necessary transactional records may continue independently of optional product analytics.

First-Party Campaign Attribution

includX operates first-party systems to measure marketing campaigns, creator partnerships, promotional activity, and eligible conversion outcomes.

These systems may process campaign identifiers, referral codes, UTM parameters, event timestamps, landing-page information, and validated conversion records.

Where permitted, attribution technologies may use pseudonymous identifiers to connect interactions across visits or sessions.

If you decline optional tracking, includX will not establish persistent visitor-level behavioral tracking solely for optional campaign attribution.

Limited operational records and verified transactions may continue to be processed where legally permitted and necessary for legitimate service, contractual, security, or accounting purposes.

First-Party Referral Link Tracking

includX may provide referral links used by creators, brands, venues, and other partners.

When someone follows a referral link, our servers may record information needed to process the redirect, protect against misuse, and measure permitted link activity.

This may include the referral identifier, associated campaign, timestamp, destination, and limited technical request information.

Where permitted by your consent choice and applicable law, referral information may be associated with later website activity or conversions.

Clicking a referral link does not automatically constitute consent to optional tracking.

Server-Side Event Tracking

Some website, campaign, and platform events may be processed directly through includX servers.

Examples include validated inquiries, registrations, campaign referrals, attendance records, and confirmed conversions.

Server-side systems may support essential operations, security, fraud prevention, contractual reporting, analytics, and commercial reconciliation.

Server-side tracking does not bypass your consent choice.

If you select Decline, we will not use server-side systems to recreate optional behavioral analytics or marketing tracking that you have declined.

Necessary transactional and operational processing may continue where permitted by applicable law.

5. Categories of Cookies and Related Technologies

Strictly Necessary Technologies

These technologies support essential website and platform functions, authentication, security, request processing, and service reliability.

They may remain active whether you select Accept or Decline, where legally permitted.

Optional Analytics, Marketing, and Attribution Technologies

These technologies help us measure website performance, analyze platform engagement, evaluate campaigns, and understand eligible visitor interactions.

They may include Google Analytics 4, optional PostHog product analytics, and permitted first-party behavioral attribution technologies.

For v1 launch, these optional technologies are managed through one combined consent choice.

Selecting Accept permits optional tracking described in this policy, subject to applicable law.

Selecting Decline disables optional tracking.

There are no separate Analytics or Marketing consent selections in the v1 interface.

6. First-Party and Third-Party Technologies

First-party technologies are operated by includX or by service providers working on our behalf.

Third-party analytics providers, including Google Analytics and PostHog, may process eligible information to deliver analytics and measurement services.

The use of these providers is governed by applicable agreements, privacy protections, consent requirements, and relevant law.

7. Campaign Links, Referrals, and Attribution

When you arrive through a campaign or referral link, the URL may contain information identifying the referring creator or partner, campaign, marketing source, or promotional activity.

We may use this information to process referrals, evaluate campaign performance, and reconcile eligible outcomes.

If you select Accept, permitted attribution technologies may associate relevant activity across visits or sessions within applicable measurement limits.

If you select Decline, we will not establish optional persistent visitor-level attribution tracking.

Limited link processing, security logging, and verified commercial transactions may still be processed where lawfully necessary.

A referral click alone does not establish that a purchase, booking, registration, or other conversion occurred.

8. Your Cookie Consent Choices

When you first visit an applicable includX website or service, you may be presented with a cookie consent notice containing two choices.

Accept

Selecting Accept permits includX to use optional analytics, marketing, and behavioral attribution technologies described in this policy, subject to applicable law.

This may include:

  • Google Analytics 4 measurement.
  • Optional PostHog product analytics.
  • Permitted first-party behavioral attribution.
  • Marketing and campaign performance measurement.

Decline

Selecting Decline disables optional analytics, marketing, and behavioral attribution tracking.

Essential website and platform functionality may remain active, including necessary authentication, security, request handling, and permitted transactional processing.

Declining optional tracking will not prevent you from accessing ordinary public website content.

No Selection

Until you select Accept, optional tracking requiring consent will remain disabled.

No selection is treated as the absence of consent, not as acceptance.

Changing Your Choice

You may change your previously recorded Accept or Decline selection through the includX cookie settings control, where the consent interface applies.

Changes will apply prospectively. Previously collected information remains subject to our Privacy Policy, applicable retention requirements, and relevant privacy rights.

We respect applicable privacy laws and legally required browser-based privacy signals.

9. Information Collected

Depending on your consent selection and the services used, applicable technologies may process:

  • Website page views and navigation events.
  • Platform interaction events.
  • Device and browser characteristics.
  • Referral and campaign parameters.
  • Approximate location derived from technical information.
  • Event timestamps.
  • Pseudonymous session identifiers, where permitted.
  • Account references and authorized product activity.
  • Verified conversion and transaction information.
  • Limited technical information needed for security and request processing.

We seek to minimize unnecessary collection and avoid including sensitive personal information in general analytics event properties.

For further information, review our Privacy Policy.

10. Cookie Duration and Data Retention

Some cookies operate only during a browser session.

Others may remain on your device for a defined period or until they are deleted.

Retention depends on the technology, provider, purpose, and applicable legal requirements.

Server-side operational, attribution, and transaction records may have retention periods separate from browser cookies.

We retain personal information according to applicable requirements and the purposes described in our Privacy Policy.

11. Managing Cookies Through Your Browser

Most browsers allow you to review, block, or delete cookies.

You may also be able to limit certain tracking technologies through browser or device privacy settings.

Disabling essential browser storage may affect authentication, preferences, or platform functionality.

Browser cookie settings do not necessarily control all lawful server-side processing associated with requests or transactions.

Such processing remains governed by this Cookies Policy, our Privacy Policy, and applicable law.

12. Changes to This Cookies Policy

We may update this Cookies Policy to reflect changes in our services, technologies, business practices, or legal requirements.

When material updates occur, we will update the effective date and provide additional notice where required.
